Unified Pearl is an AI-based invalidity claim charting tool that uses prior art from patent’s standards documents, product descriptions, scientific literature, non-patent literature, or AI-generated options to generate claim charts quickly and efficiently. To generate a claim chart, Pearl aligns each claim limitation with corresponding prior art references and citations in a tabular format based on the user’s choice. Not only does Pearl assist with invalidity analysis under §102 or §103, but also may be able to check for claim dependencies and internal consistencies by using the same patent for both the target and prior art source.
Step 1: Upload the Target Patent
Users may upload the target patent by either inserting the target patent number or by natural language.
- Uploading Target Patent via Patent Number
When users enter the patent number of the target patent into the search bar, Pearl automatically displays matching results. Users can then select the correct patent from the list to proceed.
Once users select the target patent, the program will display key information, including the publication number, names of the assignee and inventor, title, priority date, and application date. The full list of claims associated with the patent will also be generated.
Users can toggle the option to display and include dependent claims. A symbol appears next to each grouped claim, which users can click to expand and view the detailed elements of the dependent claims. From there, users can select the specific claims they wish to include in the claim chart comparison.
Once users select the claims, Pearl will automatically separate the claim into its individual elements.
Users can edit each element, further divide an element into smaller parts by clicking the icon or remove an element using the icon.
- Uploading the Target Patent via Natural Language
The natural language option allows users to manually enter the target patent. With this option, users begin by entering the title of the disclosure, followed by the scope of the disclosure. Each new claim element should be separated by new lines. Additionally, users may optionally describe their disclosures in detail using full sentences.
Step 2: Upload the Prior Art and Relevant Documents
After uploading the target patent, users can insert patents for prior art comparison by entering the patent number into the patent search engine. Users may also upload additional documents such as technical papers, product manuals, or other non-patent literature by either uploading a file or entering the content into the text box. Uploaded documents must be in .DOCX or .PDF format.
Additionally, the AI tool will generate a list of potential prior arts that may be selected and included in the claim chart comparison.
Users may include multiple patents, documents, and text entries by clicking the "Add Prior Art" button to insert additional sources. Once all documents and prior art have been added, users can click the "Generate" button to create the claim chart.
Step 3: The Claim Chart Generates with AI
Upon finishing uploading the target patent and all relevant prior art documents, Pearl will automatically generate a summary of both the target patent and the documents used for prior art comparison along with a claim chart that comprises of the claim element. The example below illustrates the accuracy and brevity of the summaries along with the structure of the claim chart.
Each target claim has a text box below for optional term explanations.
Context for each quote may be expanded by either double-clicking on the claim. All quotes can be expanded by toggling the “Extend Context” option.
Each prior art claim also has listed a corresponding citation from the patent, indicating that the quote is not only traceable but also directly cited from the source. When clicking on the citation, a pop-up will show the exact language in the prior art patent.
Along the left side of the prior art claims are thumbs up and thumbs down buttons that may be used to indicate whether the match is relevant or not.
By default, the claim chart can be exported as a .DOCX file by clicking the “Export” button on the top right of the claim chart.
When clicking the “…” button, users may explore other exporting options and features such as changing the document types, exporting only the liked quotes, or formatting the chart to align multiple prior arts horizontally.
